These Terms of Service ("Terms") govern your use of the services provided by Growth Pilot ("we", "our", "us") and outline the obligations, rights, and responsibilities between Growth Pilot and our clients ("you", "your"). By engaging with us and using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

1. Services Provided

At Growth Pilot, we offer a comprehensive range of digital marketing services, designed to help businesses generate leads, drive growth, and optimize their marketing efforts. Our services include, but are not limited to:

• Landing Page Creation: We design and develop customized landing pages that are optimized for conversions and aligned with your marketing goals.

• Advertisement via Paid Ads on Instagram/Facebook: We create and manage paid ad campaigns on Instagram and Facebook to increase visibility, engagement, and conversions.

• Copywriting: Our team produces compelling and persuasive written content for your website, ads, sales pages, and more.

• Sales Funnels: We design and implement automated sales funnels that guide prospects through the customer journey, from lead capture to conversion.

• Graphic Design: We provide visually engaging and professionally designed graphics for web, social media, and marketing collateral.
  
  

2. Payment Terms

All services are provided on a subscription basis. The first month or quarter of service will be billed according to the plan you select at the time of purchase.

• Initial Billing: Upon agreeing to the terms and selecting a service package, you will be charged based on your chosen subscription plan, which may include a one-time payment for the first month or the first quarter of services.

• Transition to New Contract: After the initial billing period (first month or quarter), you will transition to a new contract based on one of the following options:

  • A reduced, mutually agreed-upon monthly fee for continued services

  • A revenue share plan based on the volume of leads generated during our partnership. This revenue share model will be discussed and agreed upon prior to implementation.
    
    

You will be billed monthly thereafter, unless otherwise stated in the specific contract.

3.Refund Policy and Service Guarantees

Growth Pilot operates on a strict no-refund policy. All payments made for our services, including subscription fees and service charges for the first month or quarter, are non-refundable. This also applies to any upfront investments for services rendered. Once a service has been initiated or delivered, no refunds will be issued under any circumstances.

However, we stand by the quality and effectiveness of our services, which is why we offer guarantees to provide peace of mind to our clients. We are committed to delivering measurable results, and as part of our ongoing dedication to client success, we include specific performance-based guarantees in our agreements. Our goal is to make sure you feel confident in your investment with us.

Our Commitment to You:

To ensure we’re delivering the results you expect, we incorporate guarantees that align with your business objectives. For certain clients and under specific terms, we offer a performance guarantee that promises continued support if our services do not meet agreed-upon goals.

Example of Guarantee: If you haven’t doubled your initial investment within the first two months of our partnership, we will continue working for free until you achieve this result. This guarantee is designed to put our money where our mouth is, ensuring that you get the value and return you expect. If the agreed-upon outcome is not met, we will invest more time and effort to make sure your business reaches its targets, at no additional cost to you, until we fulfill the promised results.

Important Conditions:

• The performance guarantee applies only to specific plans and services, which will be clearly outlined in the agreement.

• The guarantee is contingent upon your cooperation with the strategies we’ve developed, including providing necessary materials, feedback, and timely approvals.

• To qualify for the guarantee, your business must adhere to the defined metrics and expectations outlined in the agreement, and the results must be measurable in a transparent and mutually agreed-upon way.

• Should we continue working for free under the guarantee, the client will still be required to pay for any additional services outside of the original agreement or scope.

We are committed to helping you grow your business and achieve your marketing goals, and we believe this policy will provide you with the reassurance and trust you need when partnering with Growth Pilot.

4. Client Responsibilities

As a client, you agree to:

• Provide Accurate Information: You will provide us with accurate, up-to-date, and complete information about your business and any necessary assets for us to deliver our services effectively.

• Cooperate with Our Team: You agree to cooperate with our team and provide any additional materials, approvals, or access necessary for us to complete the work as agreed.

• Review and Approve Deliverables: You will review all deliverables, including landing pages, advertisements, copy, and designs, in a timely manner, and provide feedback or approval to move forward.
  
  

5. Intellectual Property Rights

• Ownership of Deliverables: Upon full payment for services, you will own the final deliverables provided by Growth Pilot, including but not limited to landing pages, ad creatives, copy, and graphics. However, we retain the right to use any work for marketing and portfolio purposes unless otherwise agreed upon in writing.

• License to Use Materials: You grant Growth Pilot a non-exclusive, royalty-free license to use your business name, logos, trademarks, and other assets for the purpose of providing services under this agreement.
  
  

6. Service Delivery and Timelines

While we strive to deliver all services promptly and in accordance with our agreed timelines, Growth Pilot does not guarantee specific delivery dates due to factors outside our control (e.g., delays in receiving required materials, client feedback delays, etc.). We will make every effort to keep you informed of progress and any potential delays.

7. Contract Renewal and Termination

• Renewal: Upon completion of the initial term (first month or quarter), your subscription will continue under the agreed terms unless either party requests a change. If a change in pricing or service is needed, a new agreement will be drafted and signed.

• Termination by Client: You may terminate the contract at any time with written notice. However, there will be no refunds for any unused portion of the service fees.

• Termination by Growth Pilot: We reserve the right to terminate our services to you for any breach of this agreement, failure to make timely payments, or failure to cooperate with our team in a way that impedes service delivery.
  
  

8. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or confidential information exchanged during the course of the engagement. This includes any business data, marketing strategies, and other sensitive information. The obligation to maintain confidentiality will continue after the termination of the agreement.

9. Limitation of Liability

To the fullest extent permitted by law, Growth Pilot shall not be held liable for any direct, indirect, incidental, or consequential damages arising out of the use or inability to use our services. Our total liability, under any circumstance, shall be limited to the total fees paid by you for the services provided in the prior month.

10. Indemnification

You agree to indemnify and hold Growth Pilot harmless from any claims, damages, or liabilities arising out of your use of our services or any violation of these Terms. This includes any legal costs and expenses related to your breach of this agreement.

11. Amendments to the Terms

Growth Pilot reserves the right to modify or update these Terms at any time. Any changes will be communicated to you, and continued use of our services after such modifications constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Latvia. Any disputes arising out of or related to these Terms will be subject to the exclusive jurisdiction of the courts in Latvia.

As Growth Pilot operates within Europe, we work with clients across the European Union and European Economic Area (EEA).
